Abstract

Her finner du en kvalitativ bacheloroppgave som tar for seg rundskrivet av 16.10.2013 som innførte nye regler når det kommer til budgivning og avtaleslutninger fra 01.01.2014. Vår oppgave baserer seg på endringen i megler hverdag og hvilke rutiner/systemer som har blitt implementert for å imøtekomme de nye kravene. Vi har ved hjelp av intervjuer med megler og partene i boligsalg fått ett innblikk i meglerens og partenes oppfatning og utlevelse av det nye regelverket. ” Hvordan har skriftlighet i bud påvirket megler og partene ved boligsalg?” Årsaken til at vi valgte dette området var at vi synes det er en interessant og spennende problemstilling som tidligere er lite utredet. Vi ville se på hvordan megleren og kjeden håndterte en såpass signifikant regelendringer med innføring av tiltak for å imøtekomme kravene stilt av finanstilsynet, samt hvordan partene oppfattet dette i gjennom budprosesse. Oppgaven er basert på meglers og partenes oppfatning og emosjonelle meninger, samt rutinene for å opprettholde skriftlighet. Vi har i kapittel 1 startet med en enkel innføring i det nye regelverket, samt skrevet litt om vår problemstilling og avgrensninger. I kapittel 2 har vi en grundig gjennomgang av rundskrivet og hvilke regler som har blitt endret. Vi har gått i dybden på de forskjellige delene og hvordan dette skal praktiseres. Blant annet meglers plikter gjennom budprosessen. Etter denne grundige gjennomgangene ble det arbeidet en intervjuguide for våre objekter, både meglere og partene i boligsalget ble intervjuet. Vi stilte åpne spørsmål slik at objektene kunne få snakke mest mulig fritt om temaet. I kapittel 3 presenteres intervjuene og de funn som ble gjort gjennom intervjuene og vår analyse av disse knyttet opp mot teorien. Kapittel 4 er en gjennomgang av metoden med utarbeidelse av intervjuguide og en begrunnelse for vårt valg av metode. Det konkluderes i kapittel 5 med en besvarelse av vår problemstilling.

Here you will find a kvalitative bachelorsdegree, that concerns the document of 16.10.2013, who implemented new rules conceerning bidding and the final decisions of realestate transactions. The rules where implemented 01.01.2014. Our paper is based on the changes in the brokers day to day handling, what rutines they use to keep inside the rules. With the use of intervjues with the broker and the parties of the transaction, we have aquired a picture of the broker and the parts perceptions of the transaction. ”How has the written form in bidding, changed the broker and the parties behavior in a realestate transaction?” The reason we chose this topic, was that we find it very interesting to see what changes has been made, on a subjekt with little previous research. We whould like to see how the broker and the company´s have worked to fin the best solutins on this quite severe change in rules, and what measures they have done to make sure the rules are followed. We are also very interested in the parties and there perception of the transaction before and after the changes were made. The paper is base don the broker and the parties emotional perception, together with the new rutines that has been implemented. In chapter 1 we start out with a quick intrduction to the new regulations and our issue. In chapter 2 vi have a thorough of the document and what rules that have been changed. A in depth analasys of the different parts of the document and how it whould work in praksis. Among other the brokes duties in the bidding prosess. After thorough walkthrough we made an intervjuguide for are objekts, both brokers and the parties in an realestate transaction were intervjued. We aske dopen questions, so that the objekts could elaborate and talk freely about the subjekt at hand. In chapter 3 the intervjues are presented with our findings. We analyse the data and connect to det rules implemented. In chapter 4 we present the method of our paper with, the preperation of the intervjuguide and a reasoning behind are choise of method. Then at last in chapter 5 you will find the conclusion and the answering of our issue.
