dc.description.abstractFormålet med denne bacheloroppgaven har vært å undersøke om god meglerskikk kan redusere konflikter som oppstår ved skjulte feil og mangler. Vi har skrevet en teoretisk bachelor med fokus på: relevant teori, rapporter utført av TNS Gallup/Forbrukerrådet, boligsalgsannoner på FINN.no, tall og statistikk hos klageinstanser og Statistisk Sentralbyrå, samt klagesaker hos tre forskjellige klageinstanser. Problemstillingen som skal besvares i denne oppgaven er: «Hvordan kan konflikter ved skjulte feil og mangler reduseres ved hjelp av god meglerskikk». Metoden vi har brukt i denne oppgaven er både kvantitativ og kvalitativ. Vi har brukt kvantitativ metode for å tilegne oss god oversikt over tallmessige og statistiske resultater ved klagesakene hos de forskjellige klageinstansene, samt over feilinformasjonskilder. Vi har videre brukt kvalitativ metode for å innhente empirisk teori gjennom rapporter og undersøkelser som tidligere er utført av Forbrukerrådet. Vi har også gått gjennom flere klagesaker og boligsalgsannonser på FINN.no. Funnene vi har gjort gjennom undersøkelsen har vi sammenlignet med faglitteraturen vi har presentert for å få best mulig grunnlag for å besvare problemstillingen. Videre viste funnene at forbrukerne ikke har god nok tillit til eiendomsmeglerne. De føler seg mer alene i salgsprosessen, og at de ikke har en nøytral fagperson å støtte seg til. Dette gjaldt i større grad kjøperne enn selgerne. Kjøperne føler at eiendomsmegler ikke gir et nyansert og ærlig bilde av eiendommen som skal selges, og at salgsannonsene ofte gir et annet inntrykk av boligen enn hva som møter de i virkeligheten. Funnene viser også at forbrukerne føler at de får alt for lite informasjon, råd og veiledning i boligsalg- og kjøpsprosessen. Avslutningsvis kan vi se at god meglerskikk delvis kan redusere konflikter ved skjulte feil og mangler. Der klageren har oppdaget skjulte feil og mangler hvor verken selger, takstmann eller eiendomsmegler var klar over mangelen, er det ikke mye eiendomsmegler kunne gjort annerledes på grunn av hans/hennes uvitenhet om dette. Derimot ser vi at eiendomsmegler kan redusere konflikt ved å skjerpe sin opplysningsplikt ved å gi mer råd og veiledning til forbrukerne underveis i salgs/kjøpsprosessen, samt være kritisk til eget vokabular når eiendommen skal markedsføres.nb_NO
dc.description.abstractEngelsk sammendrag (abstract) The purpose of this bachelor’s thesis has been to study how good brokering practice can reduce conflicts that occur because of physical hidden defects. We have written a theoretical bachelor’s thesis with focus on pertinent theory, reports from the Consumer Council, home sales ads, numbers and statistics from appeals committee and Statistical Sentralboard and cases of complaints from three different complaint boards. The research question in this study is: «How can good brokering practice reduce conflicts of physical hidden defects?» The method we have used to gather relevant information is both quantitative and qualitative. We have used quantitative methods to gather information about statistic numbers and results from the complaint boards and different sources for misinformation. Furthermore, we have used qualitative methods to gather information through reports and examinations accomplished by the Consumer Council. We have looked through some of the cases of complaints that has been sent in to the different complaint boards, and we have been looking at different home sales ads at the website FINN.no. Throughout our research, we have compared our findings to previously presented data to get a better foundation to answer our question. The findings shows that the consumers do not have good enough trust towards the real estate agents. They feel more alone in the process and do not feel that they have a neutral professional to lean on. This applies more towards the buyer than the seller. The buyers feels that the real estate agents do not give a nuanced and truthful picture of the property, and that the property sales ad often give another impression than what the consumer meets in the reality. The findings also shows that the consumers feel that they get way too little information, advice and guidance along the way when they are selling or buying a property. At the end of our bachelor`s thesis, we can see that good brokering practice partially can reduce conflicts from physical hidden defects. In the cases where the claimant has discovered a physical hidden defect that neither the seller, assessor or the real estate agent knew about, there is not much the real estate agent could do because he was not aware of the problem. Nonetheless, the real estate agent can reduce conflicts by giving more relevant information, advice and guidance through the process of selling or buying a property. Another thing is for the real estate agent to be more critical to their own vocabulary when they are marketing the property.nb_NO
